Medical Negligence
Medical providers are trained to provide care along the same standard as a fellow practitioner—otherwise known as the standard of care. However, when the care drops below this standard, the results can be life-altering, if not deadly. Medical malpractice is not always as obvious as a sponge left in a patient’s body after surgery. Other types of medical negligence includes misdiagnosis, wrong diagnosis, incorrect treatment, surgical errors, anesthesia errors, failure to recognize a medical emergency, birth injuries due to negligence, prescribing errors, medication administration errors, and many, many other negligent acts. Medical malpractice cases are typically quite complex and require expert testimony to prove that the care provided was below the standard of care.
Just because there was an adverse outcome to a procedure or treatment does not automatically make the situation medical negligence. There are many treatments and procedures that have “acceptable risks.” Basically, acceptable risk means the benefit of the treatment or procedure outweighs the risks associated with it. In the medical malpractice context, this could mean that the alleged medical malpractice act was an acceptable risk, and therefore, did not drop below the standard of care. This is why it is important to find an attorney that is familiar with medicine and the law.
Victims of medical malpractice should get financial compensation for past and future medical expenses, pain and suffering, and other losses originating from the negligence. I have over 18 years of experience in medicine, and I use this knowledge in advocating for my clients.
