Unfair Debt Collection

It is likely that you—like most Americans—are facing some type of debt, whether it is a car loan, credit card, student loans, or even a payday loan. While having debt is often normal, it is not normal to be harassed or bullied by a financial institution to reclaim your debts. This is often one part of what is called unfair debt collection, which can refer to harassment by a financial institution to pay money back, among other things.  There are state and federal laws that debt collectors are supposed to follow, but sometimes do not.  Some common improper debt collection practices include:

  • Harassment or threats;
  • Attempting to collect on time-barred debt;
  • Misrepresentation of the amount of the debt; and
  • Pretending to be an attorney with a legal action against you.
